<h3>Remaining COVID-19 Protections</h3><h3>Just Cause Ordinance (JCO) Protections</h3>Who is protected by the law?&nbsp; Almost all Los Angeles City tenants who don’t live in LARSO properties, including single family homes. Tenants being evicted for “no-fault” reasons are entitled to relocation assistance. Tenants who are sixty-two years or older, disabled, lower income, or have minor children may receive more relocation assistance depending on whether they live in a LARSO or JCO property.</li><li>Tenants may not waive (give up) their right to relocation assistance.</li></ul><h3>Additional Protections</h3><ul><li>Building code violations: If a tenant rents a unit in a building that has been cited by the City for violations of various codes and the repairs are not completed in the time the city allowed, the City may refer the property into the Rent Escrow Account Program (REAP). If a tenant lives in a building that has been referred to the REAP program, the tenant can pay a reduced rent. The tenant can also be expected to be contacted by the City to get information about their rights if their building is part of the REAP program.</li><li>Landlords are not allowed to demand or require thar rent be paid only in cash or by electronic payment.</li><li>ALL tenants of rental units in the City of Los Angeles are protected by the Tenant Anti-Harassment Ordinance (TAHO). Tenants may only be evicted for a specific “at fault” or “no-fault” reasons as follows:<ul><li>Failure to pay rent within 3 days of receiving notice&nbsp;and the tenant owes less than one month of fair market rent for the Los Angeles-Long Beach-Glendale Metro Area.</li><li>Violation of the rental agreement</li><li>Creating a nuisance or use of unit for illegal purposes</li><li>Refusal to sign a lease which is substantially identical to original lease terms</li><li>Failure to vacate as required by County-approved relocation application.</li><li>Tenant’s household income exceeds the income limits for public housing.</li><li>A landlord or their immediate family wants to move into the rental unit</li><li>Landlord intends to remove the property from the rental housing market permanently (Ellis Act)</li><li>Landlord is complying with a government order for the tenant to vacate</li></ul><h3>Rent Stabilization Protections</h3>Who is protected by the law?&nbsp; All residential rental and mobile home units in unincorporated Los Angeles must follow these regulations unless they are exempt.&nbsp;Exemptions include:<ul><li>Units built after February 1, 1995</li><li>Single-family homes</li><li>Condominiums</li><li>Government-assisted or government-owned housing</li><li>Owner-occupied shared housing</li><li>Hotels, motels, boarding/rooming houses, or other facilities subject to transient occupancy tax</li><li>Housing accommodations in a nonprofit hospital, school, religious facility, extended care or residential care facility</li><li>Mobile home spaces held out for rent after January 1, 1990</li><li>Mobile home spaces rented for non-residential uses&nbsp;</li></ul>What Rent Protections does the law offer?&nbsp;<ul><li>A landlord cannot increase a tenant’s rent in a mobile home unit by more than 75% of the percentage change in the Consumer Price Index (inflation) or 3% of the rent charged at the time of increase, whichever is greater. Rent increases should not exceed 8%.</li><li>A landlord cannot increase a tenant’s rent in a residential unit more than 8% or less than 3% of the annual change in the Consumer Price Index (inflation). If the tenant lives in a luxury unit, the rent may be increased by an additional 2% before December 31, 2023.</li><li>Only 1 rental increase per 12-month period.</li><li>Rental increases only allowed for registered units</li><li>Landlords cannot raise the rent because the tenant has additional occupants.</li><li>Protections for tenants who refuse to pay unlawful rent increases, regardless of the reason for eviction.</li><li>Landlords cannot increase security deposit more than the amount charged at the beginning of the tenancy.</li><li>Landlords may not “bank” rent increases if not issued in a 12-month period.</li><li>Tenants may apply for a decrease in rent if Landlord has violated the ordinance, failed to maintain habitable premises, or decreased housing services unlawfully.</li></ul><h3>Tenant Buyout Agreements&nbsp;</h3><ul><li>A buyout agreement must be provided to the tenant in the tenant’s primary language and translated at the owner’s expense.</li><li>Tenants have a right not to enter a buyout negotiation or agreement.</li><li>Tenants may consult with an attorney before entering a negotiation or agreement.</li><li>Tenants have 45 days to rescind the agreement before it is fully executed.</li><li>A buyout agreement that does not clearly state the above and is in the tenant’s primary language is void.</li></ul><h3>Relocation Assistance</h3><ul><li>The County determines standard amounts of permanent relocation assistance. Tenants being evicted for “no-fault” reasons are entitled to relocation assistance.
